All orders are processed and shipped from within the European Union.

Article 1 - Definitions

In these Terms and Conditions, the following terms shall have the following meanings:

• Cooling-off period: The period within which the consumer can exercise their right of withdrawal.

• Consumer: A natural person not acting in the course of a profession or business who enters into a distance contract with the trader.

• Day: Calendar day.

• Long-term transaction: A distance contract relating to a series of products and/or services with delivery obligations spread over time.

• Durable medium: Any tool that enables the consumer or trader to store personal information in a way that allows future access and unaltered reproduction.

• Right of withdrawal: The option for the consumer to withdraw from the contract within the cooling-off period.

• Model form: The form provided by the trader for the consumer to exercise the right of withdrawal.

• Trader: The natural or legal person offering products and/or services at a distance.

• Distance contract: An agreement concluded exclusively through distance communication technologies.

• Distance communication: Means of communication without physical presence of both parties.

• Terms and Conditions: These general terms and conditions of the trader.

Article 3 - Applicability

These Terms apply to every offer and agreement between the trader and the consumer.
Before concluding a distance contract, the consumer will receive these Terms. If this is not reasonably possible, the trader will make them accessible and send them upon request.

For electronic agreements, the Terms will be provided in a downloadable format for storage.
If specific product or service terms apply, the consumer may rely on the most favorable clause in case of conflict.

Invalid provisions shall not affect the remainder of the contract and will be replaced in mutual consultation.
Situations not covered by these Terms shall be interpreted in line with their intent.

Article 4 - The Offer

• Offers with limited validity will be clearly stated.

• Offers are non-binding and subject to change.

• Descriptions are detailed and accurate, and product images are representative.

• Typographical errors do not bind the trader.

• Prices include VAT and are shown with any applicable shipping costs.

• Consumers are informed of the contract process, payment methods, delivery, and right of withdrawal.

Article 5 - The Agreement

The agreement is concluded once the consumer accepts the offer and meets the conditions.
Electronic acceptance is confirmed via email.
The trader secures data transfers and online payments.

The trader may assess creditworthiness and refuse orders with valid reasoning.
Consumers must be 18+ to purchase nicotine products and confirm this at checkout. False declarations may be reported.
Orders can be canceled within 24 hours via email.

With each delivery, the consumer will receive:

• Trader’s address for complaints

• Return and warranty policy

• Required contract information

In recurring transactions, this only applies to the first delivery.
Agreements are subject to product availability.

Article 6 - Right of Withdrawal

Consumers may withdraw from product purchases within 14 days after delivery.
During this period, the product may be inspected but not used beyond that purpose.
Products must be returned in original condition with accessories.
Withdrawal must be communicated via email or form. Return shipment is due within 14 days after notification.

If no withdrawal or return is made within the stated period, the purchase becomes final.

Article 7 - Costs of Withdrawal

• Return shipping is at the consumer’s expense.

• Refunds are issued within 14 days using the original payment method.

• Deductions may apply for damage caused by improper handling.

• No deductions if the right of withdrawal was not properly disclosed.

Article 8 - Exclusions from Withdrawal

The right of withdrawal can be excluded for:

• Custom-made or personalized products

• Perishables

• Sealed hygiene products once opened

• Software, media, or newspapers with broken seals

This exclusion must be clearly stated prior to purchase.

Article 9 - Prices

• Prices include VAT and are not increased during the offer period.

• Increases within 3 months are only allowed if legally mandated.

• Later increases allow the consumer to cancel.

• Typographical errors are not binding.

Article 10 - Delivery & Execution

• Products meet the contract and relevant legal standards.

• Deliveries occur to the address provided by the consumer.

• Orders are processed within 30 days unless agreed otherwise.

• Delays will be communicated. If not delivered, the consumer may cancel.

• Delivery estimates are not binding.

• In case of cancellation, refunds are issued within 14 days.

• Replacement products will be clearly communicated.

• The trader is not responsible for delays caused by customs or carriers.

• The consumer is the importer and responsible for local compliance.

Article 13 - Payment

• Payments are due within 7 working days.

• Consumers must report payment errors immediately.

• In case of default, reasonable costs may be charged.

Article 14 - Complaints Procedure

• Complaints must be submitted within 2 months after issue is identified.

• Complaints are responded to within 14 days.

• If not resolved, a formal dispute procedure may follow.

• A complaint does not suspend obligations.

• Valid complaints may lead to replacement or repair.

Article 15 - Liability

• The trader warns that nicotine is harmful, addictive, and potentially fatal.

• Consumers are fully responsible for their own use of nicotine products.

• No liability is accepted for consequences of use.

• Products include warning labels in accordance with EU law.

• The trader provides information to the best of its ability but accepts no responsibility for errors or omissions.

Article 16 - Disputes

These Terms are governed exclusively by the laws of the Republic of Cyprus, even if the consumer resides abroad.
The Vienna Convention does not apply.

Article 17 - Additional Provisions

Deviations must not disadvantage the consumer and must be recorded in writing or in a durable medium.
